OVERVIEW

This website is operated by How To NREMT, also known as The How To Company, and operated by The How To LLC.

Throughout these Terms, “we,” “us,” and “our” refer to How To NREMT and The How To Company.

We offer our website, student training platforms, applications, educational materials, memberships, and associated services subject to your acceptance of these Terms of Service.

By accessing our website, registering for an account, purchasing a membership, or using our services, you agree to these Terms and all applicable policies incorporated by reference.

These Terms apply to visitors, free account holders, paid members, customers, vendors, and other users.

Our online store uses Shopify's e-commerce platform. Certain student platform purchases may be processed through Stripe.

SECTION 1 - ONLINE STORE TERMS

By using our services, you represent that you meet the applicable age and eligibility requirements.

Our individual student registration and educational services are intended for adults aged 18 and older. Access provided through participating schools or educational organizations may be subject to separate eligibility requirements and applicable law.

You may not use our services for illegal or unauthorized purposes.

You must not violate applicable laws, including intellectual property and copyright laws.

You must not transmit viruses, malicious software, or destructive code.

Material violations may result in suspension or termination.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service for lawful reasons, subject to applicable consumer protection requirements and existing contractual obligations.

Certain information submitted through our services may be transmitted between authorized systems and service providers.

Personal information is handled according to our Privacy Policy.

Payment card information is processed through authorized payment infrastructure.

You may not reproduce, duplicate, copy, sell, resell, or commercially exploit our services without express written authorization.

Headings are included for convenience and do not affect the interpretation of these Terms.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

Educational information is provided for study and examination preparation.

Although we make reasonable efforts to provide accurate educational materials, we do not guarantee that every resource is accurate, complete, or current.

Information should not replace authoritative educational resources, applicable clinical protocols, qualified instructors, or professional medical judgment.

Historical information may be provided for reference purposes.

We may update educational materials when appropriate but cannot guarantee immediate updates following every change in examination requirements or professional standards.

SECTION 4 - MODIFICATIONS TO SERVICES AND PRICES

Prices and product offerings may change.

We may modify, improve, replace, or discontinue educational features, products, and services.

Changes affecting existing paid memberships will be handled in accordance with applicable law and existing contractual commitments.

Current subscription pricing and renewal terms are governed by the applicable purchase agreement and Subscription Policy.

Nothing in this section eliminates express refund rights or other applicable consumer protections.

SECTION 5 - PRODUCTS AND SERVICES

Certain products and services are available exclusively online.

Products, memberships, tutoring, Boot Camps, and other educational services may have different eligibility requirements and refund conditions.

Our Refund and Cancellation Policy governs applicable refunds.

We may limit sales to particular individuals, geographic regions, or jurisdictions when legally appropriate.

Product descriptions, availability, and pricing may change.

We do not guarantee that every educational resource will meet every student's individual expectations.

Any examination-related refund guarantee is governed exclusively by its applicable written requirements.

SECTION 6 - BILLING AND ACCOUNT INFORMATION

We may refuse, restrict, or cancel orders when reasonably necessary to prevent fraud, enforce purchase restrictions, or address material transaction errors.

We may restrict purchases associated with the same account, payment method, household, or billing address.

If an order is changed or canceled, we may attempt to contact you using the information provided during checkout.

You agree to provide accurate and complete account and purchase information.

You are responsible for maintaining current contact information and updating applicable payment information.

Recurring billing, cancellation, and refund eligibility are governed by our Subscription Policy and Refund and Cancellation Policy.

SECTION 7 - OPTIONAL TOOLS

We may provide access to third-party educational, communication, scheduling, and administrative tools.

Third-party services may be subject to their own terms and privacy policies.

Optional tools may be provided on an “as is” and “as available” basis, subject to applicable law.

We may introduce additional tools and features in the future.

New features remain subject to these Terms and any applicable supplemental conditions.

SECTION 8 - THIRD-PARTY LINKS

Our website and applications may contain links to third-party websites and services.

We do not control independently operated third-party websites and are not responsible for their content, accuracy, availability, or privacy practices.

Users should review applicable third-party policies before submitting information or completing transactions.

SECTION 9 - USER COMMENTS, FEEDBACK AND SUBMISSIONS

Users may submit comments, suggestions, feedback, reports, or other materials.

You authorize us to use voluntarily submitted feedback for legitimate business purposes, subject to applicable law and our Privacy Policy.

This provision does not automatically authorize the public disclosure of private student conversations, educational records, or other personal information.

You must not submit content that violates another person's intellectual property, privacy, or other legal rights.

We may monitor, edit, or remove unlawful, inappropriate, or otherwise prohibited submissions.

Users are responsible for the accuracy and legality of their submissions.

SECTION 10 - PERSONAL INFORMATION

Personal information submitted through our website, applications, and educational services is governed by our Privacy Policy.

This includes account information, educational records, voice interactions, AI-powered educational activities, automated workflows, and authorized third-party processing.

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS

Our website may occasionally contain typographical errors, inaccurate product descriptions, pricing errors, or other omissions.

We may correct inaccuracies and update information.

Where legally permitted, we may cancel transactions affected by material errors.

Applicable consumer rights remain unaffected.

SECTION 12 - PROHIBITED USES

You may not use our services:

a. For unlawful purposes or activities.

b. To violate applicable regulations or legal requirements.

c. To infringe upon intellectual property or privacy rights.

d. To harass, threaten, intimidate, or unlawfully discriminate against others.

e. To submit intentionally false or misleading information.

g. To collect another person's private information without authorization.

h. To engage in spam, phishing, unauthorized scraping, or automated abuse.

i. To circumvent account restrictions, payment requirements, or security measures.

j. To access another person's educational records without authorization.

k. To share accounts or distribute membership access.

l. To copy, record, redistribute, resell, or commercially exploit proprietary educational content without permission.

m. To use proprietary educational materials to train external artificial intelligence systems without express written authorization.

Violations may result in suspension or termination, subject to applicable law.

SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee uninterrupted, error-free, or continuously available services.

Educational materials, examination simulations, AI-generated responses, and automated evaluations may contain inaccuracies.

Our services are provided for educational purposes and do not replace professional instruction, medical direction, or clinical judgment.

Except where expressly stated otherwise or prohibited by applicable law, services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, How To NREMT and its authorized personnel, affiliates, contractors, and service providers disclaim applicable warranties and limit liability for losses arising from use of the services.

These limitations may include indirect, incidental, consequential, special, or punitive damages, lost profits, lost revenue, lost savings, data loss, and replacement costs.

Nothing in these Terms excludes liability that cannot legally be excluded or overrides an express contractual refund guarantee.

SECTION 14 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless How To NREMT, its parent company, affiliates, officers, directors, employees, contractors, licensors, and authorized service providers against third-party claims arising from your violation of these Terms, applicable law, or another person's rights.

This provision includes reasonable attorneys' fees where legally recoverable.

SECTION 15 - SEVERABILITY

If any provision is determined to be unlawful, void, or unenforceable, it shall be enforced to the maximum extent permitted by applicable law.

Any unenforceable portion shall be severed without affecting the remaining provisions.

SECTION 16 - TERMINATION

These Terms remain effective until terminated.

You may discontinue using our services or cancel your membership according to the applicable cancellation procedures.

We may suspend or terminate access for material violations, unauthorized account sharing, security threats, fraudulent activity, or other lawful reasons.

Termination does not automatically establish refund eligibility.

Remaining AI credits following suspension, termination, or voluntary account closure are governed by Section 23 and the applicable Refund and Cancellation Policy, subject to applicable law.

Outstanding contractual payment obligations remain enforceable where legally permitted.

Applicable intellectual property, payment, and dispute-related obligations survive termination.

SECTION 17 - RECORDING FOR LEGAL AND COMPLIANCE PURPOSES

Live classes, tutoring sessions, phone calls, Boot Camps, and virtual meetings hosted by How To NREMT may involve audio or video recording.

Where required by applicable law, appropriate consent will be obtained before recording.

Recordings may be retained for internal quality assurance, compliance monitoring, dispute resolution, refund verification, and legal protection.

Recordings collected for these purposes are not intended for marketing, advertising, or public distribution.

Access is limited to authorized personnel and service providers when reasonably necessary.

Recordings and transcripts may be processed using authorized third-party meeting, recording, or transcription tools.

Students who decline required recording consent may be unable to participate in certain activities.

AI-powered voice interactions are addressed separately in Section 24.

SECTION 18 - ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund and Cancellation Policy, Subscription Policy, and applicable supplemental agreements, constitute the agreement governing use of our services.

They supersede prior agreements and communications concerning the same subject matter unless a separate written agreement expressly provides otherwise.

Failure to enforce a provision does not constitute a waiver.

Interpretation and enforceability remain subject to applicable law.

SECTION 19 - GOVERNING LAW

These Terms and associated agreements are governed by applicable United States federal law and the laws of the State of Texas, subject to mandatory consumer protections that may apply in another jurisdiction.

Dispute venue and jurisdiction are subject to applicable law and any enforceable provisions of the relevant purchase agreement.

SECTION 20 - CHANGES TO TERMS OF SERVICE

We may update these Terms by publishing revised provisions and updating the effective date.

Material changes affecting active paid memberships will be communicated according to applicable law and existing contractual obligations.

Where permitted by law, continued use following the effective date of properly communicated changes constitutes acceptance.

SECTION 22 - FREE ACCESS MEMBERSHIPS

A. Availability

We may offer free memberships providing limited access to selected educational materials and features.

Free memberships may include limited practice questions, examination simulation opportunities, and other educational resources.

The specific limits and available features are determined by the applicable membership description.

B. Registration

Free accounts are intended for individual educational use.

Users must provide accurate registration information.

Account sharing, unauthorized transfers, and creating multiple accounts to circumvent restrictions are prohibited.

C. Upgrading

Free account holders may purchase paid memberships.

Relevant account information and educational progress may remain associated with the existing account.

D. Refund Eligibility

Students who access or use educational content, practice questions, training materials, or other educational features through a free membership before purchasing a paid membership are not eligible for the three-day satisfaction guarantee.

This restriction applies regardless of the amount of free content accessed or the duration of free membership use.

Merely creating an unused free account does not independently trigger this restriction.

Eligibility under the separate Guaranteed to Pass policy remains subject to its applicable requirements.

All refund conditions are governed by our Refund and Cancellation Policy.

E. Changes to Free Access

Free membership features may be modified or discontinued.

Free accounts do not guarantee permanent access to particular educational resources.

SECTION 23 - AI-POWERED EDUCATIONAL FEATURES

A. Availability

We may provide AI-powered tutoring, educational chat, question analysis, personalized explanations, and automated learning evaluations.

Certain features are powered by OpenAI or other authorized providers.

Availability may depend on membership type or applicable usage restrictions.

B. Educational Limitations

AI-generated responses and evaluations may contain inaccuracies.

These tools are provided for educational purposes and do not replace qualified instructors, clinical protocols, professional medical judgment, or official examination results.

AI-generated educational feedback does not independently establish professional competency or examination readiness.

C. Appropriate Use

Students must use AI features lawfully and responsibly.

Students must not misuse the systems, circumvent restrictions, submit unlawful material, or intentionally interfere with platform functionality.

Students should avoid submitting unnecessary sensitive personal or confidential information.

D. Third-Party Processing

Relevant educational information may be transmitted to OpenAI or other authorized providers to deliver AI functionality.

We seek to minimize unnecessary disclosure of directly identifying information.

Additional information is available in our Privacy Policy.

E. Modifications

AI features may be improved, replaced, restricted, or discontinued, subject to applicable consumer rights and existing contractual commitments.

F. AI Credits

Certain AI-powered features use AI credits. Depending on the applicable service and account type, these features may include the AI Tutor, Chatbot, reading answers aloud, speaking answers, the Chat Assistant for authorized organizational users, and other AI-powered features that we may identify.

Each use may deduct AI credits based on the amount of AI processing required. Credit consumption may vary based on the feature used and the nature, length, complexity, or amount of processing involved. Longer explanations, follow-up interactions, and voice-enabled uses may consume more AI credits. Where available, users may view their AI credit balance, usage, and related estimates through the applicable account interface.

AI credits provide a limited license to access and use eligible AI-powered features in accordance with these Terms. AI credits are not money or stored monetary value, have no cash value, cannot be redeemed for cash or other monetary value, and may not be transferred, sold, assigned, shared, exchanged, or moved between accounts.

AI credits included with a membership or other eligible access plan are added according to the terms of the applicable plan. Unused AI credits may carry over as described in the applicable Subscription Policy or plan terms. Additional AI credits purchased separately do not expire, subject to account status, these Terms, and applicable law.

Purchases of additional AI credits are final and nonrefundable, including when credits are unused or partially used, except for verified billing or fulfillment errors or where a refund or other remedy is required by applicable law. Additional refund conditions are governed by our Refund and Cancellation Policy.

We may prospectively change the number of AI credits required for an AI-powered feature or the number of AI credits included with a membership or plan to reflect changes in functionality, usage, technology, provider pricing, or operating costs. Such changes apply going forward and will not remove AI credits already credited to an account. Where applicable, changes to the number of AI credits included with a plan will be communicated before they take effect in accordance with applicable law and contractual obligations.

If an account is suspended or closed for a material violation of these Terms, fraud, abuse, unauthorized account sharing, circumvention of usage restrictions, or other conduct permitting termination under these Terms, remaining AI credits may be forfeited to the extent permitted by applicable law. If a user voluntarily closes an account, remaining AI credits may be forfeited. Users should contact support before voluntarily closing an account if they have remaining purchased AI credits.

The availability and use of AI credits remain subject to these Terms, the applicable Subscription Policy, Refund and Cancellation Policy, Privacy Policy, and any applicable organizational agreement.

SECTION 24 - VOICE-ENABLED EDUCATIONAL ACTIVITIES

A. Voice Features

Certain features allow students to read educational questions aloud, submit spoken answers, or interact with AI-powered educational tools.

B. Processing

When voice features are activated, audio or speech-derived text may be processed by authorized providers.

Processing is intended to interpret responses, provide educational feedback, and support the requested functionality.

C. Educational Analysis

Spoken responses may be evaluated to identify educational concepts, generate explanations, and track learning progress.

Relevant educational results may be associated with student accounts.

Automated interpretation may contain errors, and students should review important results.

D. Appropriate Use

Students must not submit another person's voice recordings without appropriate authorization.

Students should avoid including unnecessary confidential information.

These educational voice interactions are distinct from recordings of live classes and tutoring sessions.

SECTION 25 - ACCOUNT-CONNECTED LEARNING AND AUTOMATED PROCESSING

A. Account Integration

Certain educational features may retrieve relevant account information and associate educational results with the appropriate student.

B. Educational Evaluations

Our systems may automatically evaluate answers, identify learning needs, track progress, and generate personalized educational recommendations.

Automated results are educational tools rather than official professional competency determinations.

C. Automated Workflows

We may use Zapier, webhooks, databases, and other authorized technologies to support educational and administrative operations.

Information processing is governed by our Privacy Policy.

D. Educational Records

Relevant educational interactions and evaluations may be associated with student accounts.

Students may report apparent inaccuracies or submit applicable privacy requests.

SECTION 26 - MEMBERSHIPS, EXAMINATION SIMULATORS AND SCHOOL ACCOUNTS

A. Membership Levels

Memberships may be offered for EMR, EMT, AEMT, or Paramedic education.

Available content, duration, pricing, and included features depend on the purchased membership.

B. Incorrect Membership Level

Students who purchase an incorrect certification level should contact support.

Where appropriate and available, we may transfer a membership to the correct certification level.

Applicable refund rights remain governed by our Refund and Cancellation Policy.

C. Examination Simulators

Examination simulators may have limits on permitted attempts and waiting periods between attempts.

Applicable restrictions are determined by the selected membership and displayed educational features.

Simulator scores are estimates and do not represent official National Registry examination results.

D. National Registry Affiliation

How To NREMT is an independent educational service.

We are not sponsored or endorsed by the National Registry of Emergency Medical Technicians.

E. School and Organizational Accounts

Students enrolled through participating schools or EMS programs may also be subject to the applicable organizational agreement.

Authorized organizational personnel may access relevant educational information according to their assigned permissions and our Privacy Policy.

SECTION 27 - STUDENT-CREATED CONTENT AND INTELLECTUAL PROPERTY

Our proprietary educational materials, software, questions, explanations, scenarios, courses, and other original content are protected by applicable intellectual property laws.

Students receive limited permission to use purchased or otherwise authorized educational resources for personal educational purposes.

Students retain their applicable rights in original content they create, including their own explanations, reports, and custom study materials.

By submitting original content through our educational services, students grant us the permission reasonably necessary to store, process, analyze, display, and otherwise use that content to provide the requested services.

Any additional use of identifiable student content remains subject to our Privacy Policy and applicable law.

Students may not redistribute our proprietary materials or use them to train external AI systems without express written authorization.
